This agreement is between Quynh Ong (hereafter “the photographer”, “Photographer”) and Kevin Nguyen (hereafter referred to as “Client”).

Session Fees

Client agrees to pay Photographer the full Session Balance Amount on the agreed payment date(s) to secure their appointment date and time. The session fee covers the time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer. All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If Client has arranged a payment plan, order will be placed after the final payment has been received.

Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images may be available for purchase. 

Location Costs & Fees

If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The photographer will not guarantee or arrange payment on any location. Creative fee covers travel within 40 minutes of Long Beach, CA.

Terms

Upon your agreement submission and payment, Photographer will reserve the time and date agreed upon, and will not make other reservations for that time and date.
This contract is for photography services to be provided by Photographer, who will act as the sole and exclusive photographer for the Photo Session of the above named party, scheduled at the time and date listed above.

Intellectual Property

Client acknowledge that all work created under this agreement is the intellectual property of the photographer who shall retain the copyright to the images. Client may post the photographs online as they deem appropriate, such as social medial pages. Any use of the photo in featured publications or websites must be accompanied by a credit of “Photograph By: Quynh Ong ”

Limitations of Liability

While the photographer takes the utmost care with respect to shooting, editing and delivering the photographs, in the event that the photos becomes lost, stolen or destroyed, for reasons within or beyond the control of the photographer, liability is limited to a refund of the payment received. The limit of liability shall not exceed the contract price stated herein. Photographer will not be held responsible for any ruined photographs due to guests and/or other vendors, or outside of the photographer’s control.

In the event that the photographer is unable to shoot the photographs due to: illness, emergency, or accident every effort will be made to find a suitable photo replacement. If a replacement is unavailable, the payment(s) made to the photographer will be refunded in full, and return of the payment(s) shall be the entire obligation under this contract. No other damages or guarantees of any kind are recognized or warranted.

In the event that the client reschedule the Photo Session and the photographer is able to rebook the original Photo Session date, Photographer will amend the event date in this contract and client(s) will receive credit for all monies paid up to the date client(s) requests the event be rescheduled. 

Please inform Photographer at least 72 hours in advance of the session time in the event of cancellation, otherwise there will be no refund.

The photographer is not responsible for any injuries inflicted upon any participating parties. Client will be responsible for their children and for themselves and release photographer from any claims against their person or their business.

Model Release

I hereby give to Photographer the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

 a) To copyright the same in the photographer’s name or any other name that he/she may select;

 b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

 I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

Session Requests

Acknowledgement of Agreement

This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties.
